At its
February 20th meeting, the Board of Commissioners (the "Board of
Commissioners") of the County of Chatham, North Carolina (the
"County") proposes to hold a public hearing related to:
1.The
County’s authority to enter into an installment purchase contract (the
"Contract") in order to refinance an Amended and Restated Installment
Financing Contract dated as of December 11, 2008 between the County
and RBC Bank (USA), the Original Advance (as defined in the Contract)
of which was used to (1) pay the capital costs of acquiring,
constructing, installing and equipping water transmission mains, a
pump station and an elevated water storage tank in the southwest
portion of the County (the "Western Water Transmission Project"), (2)
to create a security interest in equipment associated with the Western
Water Transmission Project as more particularly described in Exhibit A
(the "Equipment") and (3) to obtain a portion of the funds to pay the
costs of the Western Water Transmission Project and the New Advance
(as defined in the Contract) of which was used to finance (1)
expansion and renovation of Northwood High School (the "High School")
and (2) the acquisition of an existing office building (the "Office
Building" and, collectively with the High School, Western Water
Transmission Project, the Equipment, the "Project") for County use and
certain other users, including Chapel Hill-Carrboro Young Men’s
Christian Association and First Health of the Carolinas, Inc.; and
2.The
County’s authority to proceed to provide, in connection with the
Contract, as grantor, a deed of trust and security agreement (the
"Deed of Trust") under which the County’s fee simple interest in the
real property on which the Office Building and the High School are
located (and collectively with the improvements thereon, the
"Mortgaged Property"), will be mortgaged by the County to create such
lien thereon as may be required for the benefit of the entity, or its
assigns, providing the funds to the County under the Contract. The
Office Building is located at 924 East Street, Pittsboro, North
Carolina 27312. The High School is located at 310 Northwood High
School Road, Pittsboro NC 27312. In addition, the County will grant,
pursuant to the Contract, a security interest in the Western Water
Transmission Project as additional security, perfected by a North
Carolina uniform commercial code financing statement (the "Financing
Statement").
The
Mortgaged Property will be subject to the mortgage provided in the
Deed of Trust. The principal amount advanced under the Contract will
not exceed $25,000,000. On payment by the County of all installment
payments due under the Contract, the Deed of Trust and any lien
created thereunder will terminate and the County’s title to the
Mortgaged Property will be unencumbered.

HEREBY GIVEN, pursuant to Sections 160A-20 of the General Statutes of

A public
hearing will be held by the Chatham County Board of Commissioners on
Monday, February 20, 2012 beginning at 6:00pm. The hearing will be
held in the auditorium of the Agriculture Building in Pittsboro, North
Carolina.
Speakers

public hearing may be continued to another date at the discretion of
the Board of Commissioners.
The purpose
of the public hearing is to receive input, both written and oral, on
proposed changes to the Watershed Protection Ordinance. Major changes
include:
1.
Definition of "Ephemeral Stream" - Refinement of the definition to
identify the origination of ephemeral streams at a score of "15" on
the NCDWQ Stream Identification Form.
Ephemeral
(storm water) Stream. A physically visible feature in the form of a
natural channel that conveys water only in direct response to
precipitation during or shortly after precipitation events. For the
purposes of this Ordinance, an ephemeral (storm water) stream is a
well-defined channel which has a minimum score of "15" on the NCDWQ
Stream Identification Form, to distinguish it from an intermittent or
perennial stream. (See, most recent version of Identification Methods
for the Origins of Intermittent and Perennial Streams, NCDWQ, Version
3.1, 2006). An ephemeral stream typically lacks the biological,
hydrological, and physical characteristics commonly associated with
continuous or intermittent conveyance of water.
2.
Definition of "Seeps and Springs" – Removal of the definition and all
references to "Seeps and Springs" from the Ordinance as they relate to
buffers.
3. An
additional item added to the Table of Uses in the Ordinance -
Requested by the NC Division of Water Quality. This item was
inadvertently omitted from the state rules as an exempt activity:
"Drainage
of a pond in a natural drainage way provided that a new riparian
buffer that meets the requirements of Section 304 of this rule is
established adjacent to the new channel."
4.
Definition of "Lot" – Clarification of the definition as it relates to
properties with multiple zoning classifications.
Lot. A
parcel of land occupied or capable of being occupied by a building or
group of buildings devoted to a common use, together with the
customary accessories and open spaces belonging to the same. A parcel
of land occupied or capable of being occupied by a building or group
of buildings devoted to an approved use, together with the customary
accessories and open spaces belonging to the same, is a "Lot" under
this Ordinance irrespective of whether the parcel has multiple zoning
classifications.
